Dear RCEHAI Member,
The Board of Directors is pleased to present the proposed amendments to the RCEHAI By-Laws for your review, comment, and suggestions. This revised document builds upon the foundation laid by the By-Laws crafted by Saligal Law Firm last September 2023.
To address the evolving needs of our organization and ensure compliance with relevant regulations, we have made several significant changes:
- Organization Type: Our Articles of Incorporation already states that we are a non-stock, non-profit organization so we found no need to add it to the first part of the by-laws.
- Committee Structure: We have empowered the Board to create additional committees as necessary to effectively serve our members.
- Membership Fee: The previously mandatory membership fee of P25,000 is now optional to support the association’s activities.
- Voting Rights: To enhance transparency, we have clarified that the Secretary and Auditor, if not Board Trustees, will not have voting rights during board meetings.
- Amenities Access: We have established that non-homeowners may use amenities subject to rules and regulations set by the Board.
Please note that while the By-Laws have been streamlined, certain provisions required by the DHSUD IRR of RA 9904 have been retained.
Your input is crucial in shaping the final By-Laws. We encourage you to carefully review the proposed amendments and submit your comments and suggestions before the August 17 Town Hall Meeting.
Once your feedback has been incorporated, a final draft will be presented for your approval through a formal voting process.
